These Terms of Service (“Terms”) govern your access to and use of www.rupenterprises.com (the “Website”) and your purchase of products from RUP Enterprises, having its business address at Shivneri Chowk, Railway Station Road, Ahilyanagar, Maharashtra, India (“RUP”, “we”, “us” or “our”).

By visiting the Website, creating an account, submitting an enquiry, placing an order or purchasing a product, you agree to these Terms, our Privacy Policy, Shipping Policy, Return and Replacement Policy, and any other policies displayed on the Website. If you do not agree, please do not use the Website or place an order.

Nothing in these Terms excludes, restricts or overrides any right or remedy that cannot lawfully be excluded under the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, or other applicable Indian law.

1. Eligibility and authority

You must be legally capable of entering into a binding contract under applicable law to place an order. If you place an order for a company, institution, club, hotel, office or another person, you confirm that you are authorised to act for that entity or person.

You are responsible for ensuring that the information supplied to us, including your name, address, telephone number, email address, delivery pincode and access details, is accurate and complete.

2. Website use

You may use the Website only for lawful personal or business purchasing purposes. You must not:

  • Use the Website for fraudulent, unlawful or misleading activity;

  • Attempt to interfere with the Website, its security, checkout, servers or connected systems;

  • Introduce malicious code, viruses or automated scraping tools;

  • Copy, reproduce or commercially exploit Website content without written permission;

  • Submit false reviews, false claims, abusive communications or fraudulent payment information; or

  • Use the Website in a manner that infringes the rights of RUP or any third party.

We may restrict or suspend access where we reasonably believe the Website is being misused or where necessary to protect customers, RUP or third parties.

3. Product information

RUP sells multi-game tables, pool tables, air-hockey tables, table-tennis tables, foosball tables, poker tables, indoor-game products and related accessories.

We make reasonable efforts to ensure that product names, photographs, descriptions, dimensions, included accessories, materials, colours, prices and availability are accurate. However:

  • Product colours and finishes may appear different because of lighting, photography and screen settings;

  • Minor variations may occur between production batches;

  • Product dimensions and weights may have reasonable manufacturing tolerances;

  • Lifestyle images may be illustrative; and

  • Included accessories are those expressly stated on the relevant product page or confirmed in writing by RUP.

Before ordering a large table, you should confirm the current colour, accessories, stock availability, product dimensions, room requirements and delivery access with RUP through WhatsApp or email.

We may correct genuine typographical errors or inaccuracies. If a material error affects an order already placed, we will contact you and provide the options available under applicable law, which may include reconfirmation, an alternative product or cancellation and refund.

4. Room size and site suitability

You are responsible for checking whether the product will fit in the intended room and whether it can be carried through the building.

Before ordering, you should measure:

  • Room length and width;

  • Doorway and passage width;

  • Staircase width and turning space;

  • Lift dimensions and weight limit;

  • Floor number and delivery access; and

  • Playing clearance around the table.

Any selection assistance provided by RUP is based on the measurements and information supplied by you. RUP is not responsible for fitting or access problems caused by incorrect, incomplete or undisclosed site information, except where responsibility cannot be excluded under applicable law.

5. Prices, GST and quotations

Unless expressly stated otherwise:

  • Prices displayed for domestic Indian orders include 18% GST;

  • Domestic shipping within India is included for serviceable locations;

  • Additional charges may apply where special handling, remote-area service, crane service, difficult access, extra labour, warehousing, re-delivery or another service outside the standard delivery is requested or required; and

  • Any additional charge will be communicated for approval before it is incurred.

International shipping, customs duty, import tax, local handling, destination charges and installation are not included unless specifically stated in a written quotation.

A quotation is valid for the period stated in it. Prices and promotions may change before an order is accepted. A discount, sale price or promotional offer cannot be combined with another offer unless expressly permitted.

6. Orders and acceptance

Your order is an offer to purchase. An automated acknowledgement, payment confirmation or cart notification does not by itself mean that the order has been finally accepted.

An order is accepted when RUP confirms acceptance, begins processing the order, dispatches the product or otherwise communicates acceptance. We may decline or cancel an order before acceptance for reasons including:

  • Product unavailability;

  • Pricing or listing error;

  • Payment failure or suspected fraud;

  • Delivery location not being serviceable;

  • Inability to confirm access or delivery requirements;

  • Legal or regulatory restrictions; or

  • Quantity limits or suspected unauthorised resale.

If we cancel an order after receiving payment and no substitute is accepted, we will process the applicable refund to the original payment method in accordance with law and the payment provider’s processing timelines.

7. Payments, COD, EMI and part payment

Available payment methods are shown at checkout or confirmed by RUP.

Cash on Delivery (“COD”), EMI and part-payment options depend on the product, order value, delivery location and payment-provider approval. These options are not guaranteed and must be confirmed before ordering.

You authorise us and our payment providers to process the information necessary to complete and verify your payment. RUP does not directly store complete card details processed by an authorised payment provider.

An order may be held or cancelled if payment is not received, is reversed, fails verification or is identified as potentially fraudulent.

8. Delivery estimates

Subject to stock availability, payment confirmation, serviceability, working days and normal operating conditions, estimated delivery timelines are:

  • Pune and Mumbai: next-day delivery may be available;

  • Other locations in Maharashtra: approximately 3–5 days;

  • Other domestic Indian locations: approximately 6–9 working days; and

  • International destinations: approximately 15–30 days depending on the destination city, customs and logistics arrangements.

These are estimates, not guaranteed delivery dates. Next-day delivery depends on the time of order, stock location, serviceability and prior confirmation by RUP.

Delays may occur because of weather, transport disruption, festivals, strikes, government restrictions, customs, remote locations, incorrect addresses, access problems, force-majeure events or other circumstances beyond reasonable control. We will make reasonable efforts to communicate a material known delay.

9. Delivery access and receipt

You or an authorised adult must be available to receive the product. You must provide accurate floor, lift, staircase, doorway, parking and access information before dispatch.

Standard delivery does not include unpacking, assembly, installation, movement to an inaccessible floor or room, removal of doors/windows, civil work, electrical work, carpentry, crane service or disposal of packaging unless expressly agreed in writing.

If delivery fails because the address is incorrect, the recipient is unavailable, access was not disclosed, or delivery is refused without a legally valid reason, reasonable re-delivery, return-transport or storage charges may apply after being communicated to you.

10. Inspection and unboxing video

Large game tables must be inspected promptly upon delivery.

To support a transit-damage or missing-part claim, you must:

  1. Record one clear, complete and continuous unboxing video beginning before the package is opened;

  2. Show the external packaging, shipping label, all sides of the package, internal packaging, product and accessories;

  3. Avoid pausing, cutting or editing the video; and

  4. Preserve the packaging until the claim is assessed.

Visible damage, missing parts or delivery discrepancy should be reported as soon as possible and no later than 24 hours after delivery, preferably within 12 hours. Send the order number, photographs and complete unboxing video to WhatsApp +91 97307 11816 or info@rupenterprises.com.

Failure to provide timely evidence may affect our ability to verify a carrier-related claim, but this clause does not remove any non-waivable right available under applicable law.

11. DIY installation

Unless expressly agreed otherwise, installation is DIY (do it yourself). A manual and/or video guidance will be provided where applicable.

You must:

  • Follow the supplied instructions;

  • Use suitable adults, tools and protective equipment;

  • Keep children away during assembly;

  • Ensure the table is level, stable and used on a suitable surface;

  • Use a qualified electrician where electrical work beyond normal plug-in connection is required; and

  • Stop installation and contact RUP if a part appears damaged, incorrect or unsafe.

Damage caused by incorrect assembly, unauthorised modification, unsuitable electrical supply, misuse or failure to follow instructions is not treated as a manufacturing defect, except where applicable law provides otherwise.

12. Warranty

Electrical components

Electrical components, including an applicable air-hockey motor or blower, carry a one-year limited warranty from the date of delivery, subject to proper installation, normal use and the exclusions below.

Non-electrical components

Manufacturing defects in other components must be identified and reported at delivery and installation. This coverage does not include normal wear, cosmetic variations within reasonable manufacturing tolerance or damage arising after delivery that is not attributable to a manufacturing defect.

Warranty exclusions

To the extent permitted by law, warranty coverage does not apply to:

  • Accidental damage, misuse, abuse or commercial use beyond the stated product purpose;

  • Water, moisture, fire, pests, corrosion or improper storage;

  • Voltage fluctuation, incorrect power supply or unauthorised electrical work;

  • Improper assembly, movement, dismantling or modification;

  • Use on an uneven or unsuitable floor;

  • Normal wear of cloth, felt, balls, cues, bats, nets, pucks, pushers and other consumable accessories;

  • Damage caused by a third-party transporter arranged independently by the customer; or

  • Repairs or alterations not authorised by RUP.

RUP may request photographs, video, proof of purchase, serial or model details and diagnostic information. Depending on the verified issue and applicable law, RUP may provide troubleshooting, a replacement part, repair, replacement product, refund or another appropriate remedy.

13. Returns, cancellations and replacement parts

Because game tables are large, heavy and difficult to reverse-transport, they are generally not eligible for return or exchange for change of mind, incorrect room size, colour preference or site-access problems after dispatch or delivery.

A verified part damaged in transit or found defective may be replaced after assessment, including review of the complete unboxing video where relevant.

If you wish to cancel before dispatch, contact RUP immediately. Cancellation is subject to written confirmation. An order that has already been dispatched, customised, specially sourced or prepared for delivery may not be cancellable except where cancellation is required under applicable law.

Nothing in this section limits remedies available for goods that are defective, materially different from their description, wrongly supplied or otherwise protected by applicable consumer law.

14. International orders

International orders require prior discussion and a written shipping quotation based on the destination, access and product.

The customer is responsible for providing correct import information and, unless expressly included in writing, for customs duty, import tax, local clearance, destination charges, permits and compliance with local requirements.

International delivery estimates may be affected by customs examination and local authorities. Any warranty or replacement-part shipment for an international order will be assessed individually, including allocation of freight, customs and local charges, subject to applicable law and the agreed quotation.

15. Product safety and acceptable use

Products must be used only for their intended indoor recreational or furniture purpose and in accordance with instructions.

Children must be appropriately supervised. Do not sit, stand, jump or place excessive weight on a playing surface unless the product is expressly designed for that use. Keep liquids away from electrical components and disconnect electrical products before cleaning or maintenance.

You are responsible for routine inspection, tightening of fasteners, levelling and safe storage of accessories.

16. Accounts and security

If the Website permits customer accounts, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account. Notify us promptly if you suspect unauthorised use.

We may suspend an account reasonably believed to be compromised, fraudulent or used in breach of these Terms.

17. Reviews, photographs and submitted content

If you submit a review, photograph, video, testimonial or other content, you confirm that:

  • The content is truthful and based on your genuine experience;

  • You own the content or have permission to provide it;

  • It does not violate privacy, intellectual-property or other rights; and

  • It is not unlawful, abusive, deceptive or defamatory.

You grant RUP a non-exclusive, worldwide, royalty-free licence to use, reproduce and display submitted content for operating and promoting RUP, subject to our Privacy Policy and any consent requirements. You may contact us to request that identifiable customer content be removed, subject to legal and operational requirements.

We may moderate or remove content that violates these Terms, but we do not undertake to publish every submission.

18. Intellectual property

The RUP name, logos, Website design, text, graphics, product presentation, photographs, videos and other original content are owned by or licensed to RUP and are protected by applicable intellectual-property law.

You may view and download Website material only for personal evaluation of RUP products. No commercial reproduction, modification, distribution, resale, scraping or brand use is permitted without prior written consent.

Third-party trademarks remain the property of their respective owners.

19. Third-party services and links

The Website may use or link to services operated by Shopify, payment providers, logistics companies, WhatsApp, Instagram, YouTube, Amazon, Google, Meta, Microsoft and other third parties.

Third-party services are governed by their own terms and privacy practices. RUP is not responsible for the independent content, availability or acts of third-party services, except to the extent responsibility arises under applicable law or from a service used by RUP to fulfil your order.

20. Privacy and communications

Personal information is handled in accordance with our Privacy Policy and applicable data-protection law.

We may use the contact information you provide to:

  • Process and deliver orders;

  • Provide service, warranty and replacement support;

  • Prevent fraud and maintain security;

  • Send transactional updates; and

  • Send marketing communications where permitted and subject to applicable consent or opt-out rights.

You may unsubscribe from promotional email using the unsubscribe option provided. Transactional communications necessary for an existing order or legal obligation may continue.

21. Website availability

We aim to keep the Website accurate and available but do not guarantee uninterrupted or error-free operation. We may update, suspend or discontinue Website features for maintenance, security, legal or business reasons.

We are not responsible for temporary unavailability beyond our reasonable control, but this does not affect an accepted order or statutory right.

22. Disclaimer and limitation of liability

To the maximum extent permitted by law:

  • RUP is not liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable when the contract was formed;

  • RUP is not liable for loss caused by inaccurate measurements, undisclosed delivery access, improper installation, misuse, unauthorised modification or failure to follow instructions; and

  • RUP’s aggregate contractual liability relating to a product will not exceed the amount paid for that product, except where a different remedy or liability is required by law.

Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability or consumer remedy that applicable law does not permit us to exclude or limit.

23. Indemnity

To the extent permitted by law, you agree to be responsible for loss or claims reasonably arising from your unlawful misuse of the Website, infringement of third-party rights, fraudulent conduct or material breach of these Terms. This clause does not require a consumer to indemnify RUP for RUP’s own negligence, breach of law or wrongful conduct.

24. Force majeure

RUP is not responsible for delay or failure caused by events beyond reasonable control, including natural disaster, flood, fire, epidemic, government restriction, war, civil disturbance, strike, transport interruption, carrier failure, power or network failure, customs delay or shortage of materials.

Where such an event materially affects an accepted order, we will communicate reasonable available options in accordance with applicable law.

25. Governing law and dispute resolution

These Terms are governed by the laws of India.

If a concern arises, please first contact RUP so that we can attempt to resolve it promptly. Nothing in these Terms restricts a consumer’s right to approach a competent Consumer Commission, court, regulator or other authority having jurisdiction under applicable law, including jurisdiction available based on the consumer’s residence or place of work where provided by law.

Subject to those statutory rights and mandatory jurisdiction rules, courts having lawful jurisdiction in Maharashtra may hear disputes relating to these Terms.

Please include your name, contact information, order number and a clear description of the grievance. We aim to acknowledge a consumer complaint within 48 hours and resolve it within one month from receipt, in accordance with applicable requirements, subject to the complexity of the matter and information required.

27. Changes to these Terms

We may update these Terms to reflect changes in products, operations, technology or law. The revised Terms will be posted on the Website with an updated effective date.

Changes will apply prospectively. Terms applicable to an already accepted order will not be changed retroactively unless required by law or agreed with you.

28. Severability and waiver

If any provision is held invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.

A delay or failure by RUP to enforce a provision is not a waiver of that provision or any other right.

29. Entire agreement

These Terms, the order confirmation, applicable product page, written quotation and policies referenced in these Terms form the agreement concerning your use of the Website and purchase.

If a specific written quotation or order confirmation expressly conflicts with these general Terms, the specific written term will control for that order, subject to applicable law.
